Resisting arrest and law enforcement is usually charged as a misdemeanor under Indiana law. Generally speaking, resisting law enforcement or resisting arrest is charged when a group of people has assembled and someone refuses to leave when told. The statute is written very broadly to encompass any conduct that runs counter to a police officer’s intention communicated by turning on the siren or flashing the lights. If the officer thinks your action interferes with his or her responsibilities, the office has the option of arresting you for resisting law enforcement.

If you resist arrest in a vehicle along an interstate such as I-65, I-80/94, U.S. 41, U.S. 30, Rt.2, the Boremen Expressway or the Chicago Skyway, you will be charged with a D felony.
